When you contact us, fill out a form, apply for a position, or otherwise communicate with us, we may collect information such as your name, email address, phone number, mailing address, the contents of your message, and any other information you choose to provide (including resume or employment details if you apply for a job).

When you visit the Site, certain information is collected automatically through cookies and similar technologies, including your IP address, device and browser type, operating system, language settings, referring and exit pages, the pages and content you view, the dates and times of your visits, approximate location derived from your IP address, and similar usage and diagnostic data.

Platform and analytics data. The Site is hosted on the Squarespace platform. Squarespace and the analytics and feature-management services it uses (which may include providers such as Statsig) automatically collect technical and usage information in order to host, operate, secure, maintain, and improve the platform. This processing is performed by the platform itself as part of normal website operation, and some of it occurs by default across sites hosted on Squarespace.

These Terms of Service ("Terms") govern your access to and use of mesaproduction.com (the "Site"), operated by Mesa Production LLC ("Mesa Production," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Notice. If you do not agree, do not use the Site.

TO THE FULLEST EXTENT PERMITTED BY LAW, MESA PRODUCTION AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights.

Informal resolution. Before bringing any formal claim, you agree to first contact us at info@mesaproduction.com and attempt in good faith to resolve the dispute informally for at least 30 days.

‍ ‍

Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to the Site or these Terms that is not resolved informally shall be resolved by final and binding arbitration administered by a recognized arbitration provider under its applicable rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration shall take place in Colorado, and judgment on the award may be entered in any court of competent jurisdiction.

Class action waiver. You and Mesa Production agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.

Jury trial waiver. To the extent a dispute proceeds in court rather than arbitration, you and Mesa Production each waive any right to a jury trial.

Nothing in this section limits any rights that cannot be waived under applicable law.

‍ ‍

11. Governing Law

‍ ‍

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Subject to Section 10, the state and federal courts located in Colorado shall have exclusive jurisdiction over any dispute not subject to arbitration.

12. Changes to These Terms

‍ ‍

We may modify these Terms at any time. When we do, we will update the "Effective Date" above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.

‍ ‍

13. Severability; Entire Agreement

‍ ‍

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Notice, constitute the entire agreement between you and Mesa Production regarding the Site.
