Mesa Production LLC ("Mesa Production," "we," "us," or "our") respects your privacy. This Privacy Notice explains how we collect, use, disclose, and protect information when you visit mesaproduction.com (the "Site") or otherwise interact with us.
By using the Site, you agree to the practices described in this Privacy Notice. If you do not agree, please do not use the Site.
1. Information We Collect
Information you provide to us. When you contact us, fill out a form, apply for a position, or otherwise communicate with us, we may collect information such as your name, email address, phone number, mailing address, the contents of your message, and any other information you choose to provide (including resume or employment details if you apply for a job).
Information collected automatically. When you visit the Site, certain information is collected automatically through cookies and similar technologies, including your IP address, device and browser type, operating system, language settings, referring and exit pages, the pages and content you view, the dates and times of your visits, approximate location derived from your IP address, and similar usage and diagnostic data.
Platform and analytics data. The Site is hosted on the Squarespace platform. Squarespace and the analytics and feature-management services it uses (which may include providers such as Statsig) automatically collect technical and usage information in order to host, operate, secure, maintain, and improve the platform. This processing is performed by the platform itself as part of normal website operation, and some of it occurs by default across sites hosted on Squarespace.
2. How We Use Information
We use the information we collect to:
Operate, maintain, secure, and improve the Site;
Respond to your inquiries and provide customer or business support;
Evaluate and communicate with you about employment opportunities;
Understand how visitors use the Site through analytics;
Detect, prevent, and address technical issues, fraud, or misuse;
Comply with legal obligations and enforce our agreements.
3. Cookies and Similar Technologies

Service providers. With vendors who perform services on our behalf, such as our website host (Squarespace), analytics providers, and IT or communications providers, who are permitted to use the information only to provide those services.
Legal and safety. When required by law, subpoena, or legal process, or to protect the rights, property, or safety of Mesa Production, our visitors, or others.
Business transfers. In connection with a merger, acquisition, financing, reorganization, or sale of assets, where information may be transferred as part of that transaction.
5. Third-Party Links
The Site may contain links to third-party websites or services that we do not control. This Privacy Notice does not apply to those third parties, and we are not responsible for their content or privacy practices. We encourage you to review the privacy policies of any third-party sites you visit.
6. Data Retention
We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Notice, to comply with our legal obligations, resolve disputes, and enforce our agreements, after which it is deleted or anonymized.
7. Security
We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Your Privacy Rights
Depending on where you live, you may have rights regarding your personal information, including the right to request access to, correction of, or deletion of your personal information, and to opt out of certain processing. To exercise any available right, contact us using the details in Section 12. We will respond as required by applicable law and will not discriminate against you for exercising your rights.
California Residents
If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, "CCPA/CPRA"), provides you with additional rights:
Right to know / access the categories and specific pieces of personal information we have collected about you, the sources, the purposes, and the categories of third parties with whom we share it;
Right to delete personal information we have collected from you, subject to exceptions;
Right to correct inaccurate personal information;
Right to opt out of the "sale" or "sharing" of personal information;
Right to limit the use of sensitive personal information;
Right to non-discrimination for exercising your rights.
In the preceding 12 months, we may have collected the following categories of personal information: identifiers (such as name, email, phone number, and IP address); internet or other electronic network activity information (such as browsing and usage data); geolocation data (approximate, derived from IP address); and information you voluntarily provide through forms or applications.
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. Where supported, we honor opt-out preference signals such as the Global Privacy Control (GPC).
To submit a request, contact us using the information in Section 12. We may need to verify your identity before fulfilling your request. You may use an authorized agent to submit a request on your behalf.
9. Children's Privacy
The Site is intended for a general business audience and is not directed to children. We do not knowingly collect personal information from children under 16. If you believe a child has provided us personal information, please contact us so we can delete it.
10. Visitors Outside Colorado / the United States
The Site is operated in the United States. If you access the Site from another state or country, your information will be processed in the United States, where data protection laws may differ from those in your jurisdiction.
11. Changes to This Privacy Notice
We may update this Privacy Notice from time to time. When we do, we will revise the "Effective Date" above. Your continued use of the Site after changes are posted constitutes acceptance of the updated Privacy Notice.

Terms of Service

These Terms of Service ("Terms") govern your access to and use of mesaproduction.com (the "Site"), operated by Mesa Production LLC ("Mesa Production," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Notice. If you do not agree, do not use the Site.
1. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Site. By using the Site, you represent that you meet this requirement.
2. Use of the Site
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for lawful, informational, and business purposes. You agree not to:
Use the Site in any way that violates applicable law or regulation;
Attempt to gain unauthorized access to the Site, its servers, or related systems;
Interfere with or disrupt the operation, security, or performance of the Site;
Use any automated means to access, scrape, or collect data from the Site without our written permission;
Use the Site to transmit harmful code, spam, or unsolicited communications; or

The Site and its content—including text, graphics, logos, images, and design—are owned by or licensed to Mesa Production and are protected by intellectual property laws. Except as expressly permitted, you may not copy, reproduce, distribute, modify, or create derivative works from the Site or its content without our prior written consent. "Mesa Production" and related marks are the property of Mesa Production LLC.

If you submit information to us through a contact form, application, or other communication, you represent that the information is accurate and that you have the right to provide it. You grant us the right to use such submissions to respond to you and operate our business. Do not submit confidential or sensitive information through the Site unless requested.
5. Employment Inquiries
Any career or employment information on the Site is provided for convenience and does not constitute an offer of employment or guarantee of any position. Submitting an application does not create an employment relationship.
6. Third-Party Links and Services
The Site may link to or incorporate third-party websites, content, or services that we do not control. We provide these for convenience and do not endorse and are not responsible for them. Your use of third-party websites and services is governed by their own terms and policies.

8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MESA PRODUCTION AND ITS OWNERS, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
9. Indemnification
You agree to indemnify and hold harmless Mesa Production and its owners, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Site or your violation of these Terms.
10. Dispute Resolution; Arbitration; Class Action Waiver
Please read this section carefully. It affects your legal rights.
Informal resolution. Before bringing any formal claim, you agree to first contact us at info@mesaproduction.com and attempt in good faith to resolve the dispute informally for at least 30 days.
Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to the Site or these Terms that is not resolved informally shall be resolved by final and binding arbitration administered by a recognized arbitration provider under its applicable rules, rather than in court, except that either party may bring an individual claim in small-claims court. The arbitration shall take place in Colorado, and judgment on the award may be entered in any court of competent jurisdiction.
Class action waiver. You and Mesa Production agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims.
Jury trial waiver. To the extent a dispute proceeds in court rather than arbitration, you and Mesa Production each waive any right to a jury trial.
Nothing in this section limits any rights that cannot be waived under applicable law.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Subject to Section 10, the state and federal courts located in Colorado shall have exclusive jurisdiction over any dispute not subject to arbitration.
12. Changes to These Terms
We may modify these Terms at any time. When we do, we will update the "Effective Date" above. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
13. Severability; Entire Agreement
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Notice, constitute the entire agreement between you and Mesa Production regarding the Site.
